EMV Srl declares that the personal data provided by the User and acquired at the time of requests for information and/or contact, registration to the site and the use of services through smartphones or any other internet-enabled device, as well as the data necessary to provide such services, include browsing data and data used to purchase the products or services offered by EMV Srl but also only the browsing data of the website by Users, will be processed in accordance with applicable law. The computer systems and software procedures used to run the Website during its normal operation acquire certain personal data, whose transmission is implicit in the use of the internet. This information is not collected for its association with the data subjects but may by its nature, including through processing and association with data held by third parties, enable the identification of the user. Purposes of the processing and legal basis

Data are processed for purposes:

1) strictly connected with and necessary for registration with the www.emvsrl.com website, services and/or apps developed or made available by EMV Srl the use of the related IT services, the management of contact or information requests, to purchase products and services offered the EMV Srl website;
2) for the additional activities connected with the management of requests made by the User/Customer and the sending of the reply that may envisage the transmission of promotional material; for the completion of the purchase order of products and services offered, including aspects relating to payment by credit card, the management of shipments, any exercise of the right to change your mind provided for distance purchases, updating the availability of temporarily unavailable products and services;
3) related with the fulfilment of obligations envisaged by European Union and national legislation, the protection of the public order, the assessment and repression of crimes;
4) direct marketing, i.e. sending advertising materials, direct selling, for carrying out market or commercial communication surveys on products and/or services offered by EMV Srl, a single member company; this activity may also concern products and services of companies of the EMV Srl Group and be carried out by sending advertising/information/promotional material and/or invitations to participate in initiatives, events and offers aimed at rewarding users/customers, carried out with “traditional” methods (e.g. by snail mail and/or operator assisted calls), or through “automated” contact systems (e.g. SMS and/or MMS, automated calls without human intervention, e-mail, fax, interactive applications), pursuant to art. 130, paragraph 1 and 2 of Legislative Decree 196/03 et seq.;
The provision of data for the purpose laid down in points 1), 2), and 3), related to a pre-contractual and/or contractual phase or useful for a user’s request or required by a specific legislative provision, is mandatory. If you fail to provide this data, it will not be possible to receive the information and have access to any services requested; with regard to point 4) of this Notice, consent to the processing of data by the user/customer is instead free and optional and may be revoked at any time without consequences on the usability of products and services, except that EMV Srl will no longer be able to keep users/customers updated on new initiatives or special promotions or benefits.
EMV Srl may send commercial communications relating to products and/or services similar to those already provided, pursuant to Directive 2002/58/EU, using the email or snail mail address provided by you in these cases, to which you may object according to the procedures and using the contact details indicated below.

Methods, logic of processing, retention times and security measures

The processing is also carried out with the aid of electronic or automated means and is carried out by EMV Srl and/or by third parties which EMV Srl can use to store, manage and transmit the data. Organisation and processing logics will also be applied to your personal data in relation to access and usage logs for online services, products and services used for the purposes mentioned above and in a way that ensures the security and confidentiality of the data. The personal data processed will be retained for the period of time envisaged by the legislation applicable at the time.
Again with regard to data security, in the sections of the Web site dedicated to specific services, where the user’s personal data are requested, the data are encrypted through a security technology known as Secure Sockets Layer (SSL). The SSL technology codes the data before they are exchanged via the Internet between the user’s device and EMV Srl’s central systems, thereby rendering the personal data unintelligible to unauthorised persons and guaranteeing the confidentiality of the information transmitted; moreover, transactions through electronic payment systems are completed directly by means of the payment service provider (PSP) and EMV Srl retains only the minimum set of information needed to handle any complaints. Precisely with reference to the personal data protection aspects, the user/customer is invited, pursuant to art. 33 of the GDPR to report EMV Srl any circumstances or events which could result in a personal data breach in order to allow for prompt evaluation and the adoption of any actions aimed at countering this event by sending a notice to privacy@emvsrl.com or by contacting the Customer Service department. The measures adopted by EMV Srl do not exempt the Customer from the duty to pay close attention to the use, where required, of a password/PIN of appropriate complexity, that must be updated periodically, especially if such information has been breached by/become known to third parties, and to keep them safe and inaccessible to third parties, so as to prevent their improper and unauthorised use.

Scope of data communication and transfer.

To pursue the purposes described above, EMV Srl may disclose and outsource the processing, in Italy and abroad, of the personal data of its users/customers to third parties with whom the company does business, in the case that such third parties provide services at our request. EMV Srl provides to these third parties only the information necessary to carry out the requested services and takes all necessary measures to protect your personal data. Data may be transferred outside the European Economic Area when necessary for the management of your contractual agreement. In this case, the recipients of the data will be required to comply with equivalent protection and security obligations to those guaranteed by the Controller. In the case of use of services offered directly by Partners, we provide only the data strictly necessary for the performance of such services. In any case, only the data necessary to the purposes envisaged will be disclosed and, when required, the guarantees applicable to data transfer to third countries will be applied. EMV Srl may disclose your personal data to its commercial service providers, for marketing reasons, appointed as external data processors for this purpose. Rights of data subjects

You may exercise the rights granted to you by law at any time, including the right to:
a. access your personal data, obtain evidence of the purposes pursued by the Controller, the categories of data involved, the recipients to whom the personal data may be disclosed, the period for which data will be stored, the existence of automated decision-making processes;
b. obtain, without undue delay, the rectification of inaccurate personal data concerning you;
c. obtain, in the cases provided for, the erasure of your data;
d. obtain the restriction of processing or to object to processing, when possible;
e) request the data portability of the data you have provided to EMV Srl i.e. to receive it in a structured, commonly used and machine-readable format, also in order to transmit it to another controller, in accordance with the limits and constraints provided for in art. 20 of the GDPR;
Moreover, you may lodge a complaint with the relevant Data Protection Authority in accordance with art. 77 of the GDPR.
For the processing operations referred to in point 4) of the purposes, the Client may always withdraw consent and exercise the right to object to direct marketing (in “traditional” or “automated” form). The objection, unless otherwise instructed, will apply to both traditional and automated communications.
